Unless you have read and accepted all the terms of this Agreement, you have no right to download, install or use this software and related services. Your downloading, installation, use, etc. shall be deemed that you have read and agreed to the constraints of the above agreement.

If you are under the age of 18, please read this agreement and the above other agreements in the company of your legal guardian, and pay special attention to the terms of use for minors. In particular, if you are a child under the age of 14, you should ask your guardian to carefully read the InkMark Privacy》 before completing the account registration. Scope of the Agreement: This agreement is an agreement between you and InkMark regarding your downloading, installation, use, copying of this software, and use of InkMark related services.

About this service

Content of this service

The content of this service refers to the cross-platform note-taking tool (hereinafter referred to as "Mokebi") provided by Mokebi to users, which supports single-person and multi-person participation. On the basis of sending instant messaging services such as voice messages, videos, pictures, emoticons and texts, it also provides users with software licenses and services including but not limited to relationship chain expansion, convenient tools, open platforms, and information exchange with other software or hardware (hereinafter referred to as "this service").

Form of this service

You need to download the Mokebi client software to use this service. For these software, Mokebi gives you a personal, non-transferable and non-exclusive license. The web version and watch version of Mokebi need to log in by scanning the QR code. You can only use these software and services for the purpose of accessing or using this service.
The Mokebi client software in this service may provide multiple application versions including but not limited to iOS, Android, HarmonyOS, etc. Users must choose the software version that matches the installed terminal device.

Scope of this Service License

Mokebi grants you a personal, non-transferable and non-exclusive license to use this software. You may install, use, display and run this software on a single terminal device for non-commercial purposes.
You may make a copy of this software for the purpose of using this software and services, only for backup. The backup copy must contain all copyright information contained in the original software.
All other rights not expressly authorized by this clause and other terms of this Agreement are still reserved by Mokebi, and you must obtain Mokebi's written permission when exercising these rights. If Mokebi does not exercise any of the aforementioned rights, it does not constitute a waiver of such rights.

Software Acquisition

Mokebi may have developed different software versions for different terminal devices. You should choose to download the appropriate version for installation according to the actual situation.
After downloading the installation program, you need to follow the steps prompted by the program to install it correctly.

Software Update

In order to improve user experience and improve service content, InkMark will continue to work hard to develop new services and provide you with software updates from time to time (these updates may take the form of software replacement, modification, function enhancement, version upgrade, etc.).
In order to ensure the security and functional consistency of this software and service, InkMark has the right to update the software without special notice to you, or change or limit some of the functional effects of the software.
After the new version of this software is released, the old version of the software may not be available. InkMark does not guarantee that the old version of the software will continue to be available and provide corresponding customer service. Please check and download the latest version at any time.

User Personal Information Protection

Protecting user personal information is a basic principle of InkMark, and InkMark will take reasonable measures to protect user personal information. Except for the circumstances stipulated by laws and regulations, InkMark will not disclose or disclose user personal information to third parties without the user's permission. InkMark uses professional encrypted storage and transmission methods for relevant information to ensure the security of user personal information.
When you register an account or use this service, you need to provide some necessary information, for example: in order to provide you with account registration services or user identification, you need to fill in your mobile phone number; the location sharing function requires you to agree to use your geographical location information, etc. If there are special provisions in national laws, regulations or policies, you need to provide real identity information. If the information you provide is incomplete, you will not be able to use this service or will be restricted during use.
In general, you can browse and modify the information you submit at any time, but for security and identity identification (such as number complaint service), you may not be able to modify the initial registration information and other verification information provided during registration.
Mokebi will use various security technologies and procedures to establish a sound management system to protect your personal information from unauthorized access, use or disclosure.
Without your consent, Mokebi will not disclose your personal information to any company, organization or individual outside of Mokebi, except as otherwise provided by laws and regulations.
Mokebi attaches great importance to the protection of personal information of minors. If you are a minor under the age of 18, you should obtain the written consent of your parents or legal guardians before using Mokebi's services.

User Behavior Standards

Information Content Standards

The information content described in this article refers to any content produced, copied, published, and disseminated by users during the use of this software and services, including but not limited to the avatar, name, user description, profile, etc. of the InkMark account or functional account Registration information, or text, voice, pictures, videos, emoticons, etc. sent, as well as other content generated by the use of the InkMark account or functional account or this software and services.

You understand and agree that InkMark has been committed to providing users with a civilized, healthy, standardized and orderly network environment. You shall not use the InkMark account or functional account or this software and services to produce, copy, publish, and disseminate the following content that interferes with the normal operation of InkMark and infringes on the legitimate rights and interests of other users or third parties, including but not limited to:

Publishing, transmitting, disseminating, and storing content that violates all laws, regulations, and policies of China, the United States, Europe, or other government agencies:

(1) Opposing the basic principles established by the Constitution;

(2) Endangering national security, leaking state secrets, subverting the state power, and undermining national unity;

(3) Damaging national honor and interests;

(4) Distorting, vilifying, blaspheming, and denying the deeds and spirit of heroes and martyrs, and insulting, slandering, or otherwise infringing on the names, portraits, reputations, and honors of heroes and martyrs;

(5) Promoting terrorism, extremism, or inciting terrorist or extremist activities;

(6) Inciting ethnic hatred and discrimination, and undermining national unity;

(7) Undermining national religious policies, promoting cults and feudal superstitions;

(8) Spreading rumors, disrupting social order, and undermining social stability;

(9) Spreading obscenity, pornography, gambling, violence, or other material.

(10) Insulting or defaming others, infringing their reputation, privacy and other legitimate rights and interests;

(11) Using exaggerated titles, the content of which is seriously inconsistent with the title;

(12) Hype gossip, scandal, bad deeds, etc.;

(13) Improper comments on natural disasters, major accidents and other disasters;

(14) Containing sexual innuendos, sexual provocations, etc. that can easily cause people to have sexual associations;

(15) Displaying blood, horror, cruelty, etc. that cause physical and mental discomfort;

(16) Inciting discrimination against groups or regions;

(17) Promoting vulgar, banal, and kitsch content;

(18) May cause minors to imitate unsafe behaviors and violate social ethics, induce minors to have bad habits, etc.;

(19) Content that infringes on the legitimate rights and interests of minors or harms the physical and mental health of minors;

(20) Other content that has a negative impact on the network ecology.

(21) Inciting illegal assembly, association, procession, demonstration, gathering to disturb social order;

(22) Activities in the name of illegal non-governmental organizations;

(23) When you are in China, you do not comply with the "Interim Provisions on the Development and Management of Public Information Services of Instant Messaging Tools" and the "Seven Bottom Lines" requirements of abiding by laws and regulations, the socialist system, national interests, the legitimate interests of citizens, public order, social morality and information authenticity; when you are in the United States or other countries or regions, you violate the "export" behavior regulated by U.S. export control regulations;

(24) Other content prohibited by laws and administrative regulations

Publishing, transmitting, disseminating, and storing content that infringes on the legal rights of others such as reputation, portrait rights, intellectual property rights, and trade secrets;
Involving the privacy, personal information or data of others;
Publishing, transmitting, and disseminating harassment, advertising information, excessive marketing information, and spam or containing any sexual or sexual innuendo;
Other information that violates laws, regulations, policies, public order and good customs, social morality, or interferes with the normal operation of Mo Ke Pen and infringes on the legitimate rights and interests of other users or third parties.

Software Usage Specifications

Unless permitted by law or with written permission from Mokkebi, you may not engage in the following actions while using this software:

Delete copyright information on this software and its copies;
Reverse engineer, reverse assemble, reverse compile this software, or otherwise attempt to discover the source code of this software;
Use, rent, lend, copy, modify, link, reprint, compile, publish, establish mirror sites, etc. for content that Mokkebi owns intellectual property rights;
Copy, modify, add, delete, mount, run, or create any derivative works of this software or data released to any terminal memory during the operation of this software, interactive data between the client and the server during the operation of the software, and system data required for the operation of this software, including but not limited to the use of plug-ins, external plug-ins, or third-party tools/services not authorized by Mokkebi to access this software and related systems;
By modifying or forging the instructions and data in the software operation, adding, deleting, changing the functions or operation effects of the software, or operating or disseminating the software and methods used for the above purposes to the public, regardless of whether these behaviors are for commercial purposes;
Log in or use the Mokebi software and services through third-party software, plug-ins, plug-ins, systems that are not developed and authorized by Mokebi, or produce, publish, and disseminate the above tools;
Interfere with this software and its components, modules, and data by yourself or authorize others or third-party software;
Other behaviors that are not expressly authorized by Mokebi.

You understand and agree that based on comprehensive factors such as user experience, the operational safety of Mokebi or related service platforms, platform rules and requirements, and healthy development, Mokebi has the right to choose the objects of service provision, the right to decide the function settings, and the right to decide the objects and scope of function opening, data interface and related data disclosure. In the following circumstances, we have the right to suspend or terminate the provision of this service depending on the specific circumstances, including but not limited to:

Violation of laws, regulations or provisions of this Agreement;
Impact on service experience;
There are security risks;
The interface, style, function, description or user experience is similar to Mokebi or its service platform, which may cause Mokebi users to believe that the functions or services they use are from Mokebi or authorized by Mokebi;
Violation of the operating principles of Mokebi or its service platform, or failure to meet other management requirements of Mokebi.

Service Operation Specifications

Unless permitted by law or with written permission from Mokbi, you may not engage in the following actions during the use of this service:

Submit or publish false information, or impersonate or use the name of another person;
Induce other users to click on link pages or share information;
Fabricate facts, conceal the truth to mislead or deceive others;
Infringe on the legal rights of others such as reputation, portrait rights, intellectual property rights, trade secrets, etc.;
Use Mokbi accounts, functional accounts and any functions, as well as third-party operating platforms for promotion or mutual promotion without the written permission of Mokbi;
Use Mokbi accounts or functional accounts or this software and services to engage in any illegal or criminal activities;
Produce, publish methods and tools related to the above actions, or operate or disseminate such methods and tools, regardless of whether these actions are for commercial purposes;
Other acts that violate laws and regulations, infringe on the legitimate rights and interests of other users, interfere with the normal operation of products, or are not explicitly authorized by Mokbi.

Be responsible for your own behavior

You fully understand and agree that you must be responsible for all actions under your registered account, including any content, comments, likes, recommendations, etc. you publish, and any consequences arising therefrom. You should make your own judgment on the content in this service and bear all risks arising from the use of the content, including risks arising from reliance on the correctness, completeness or practicality of the content. Mokebi cannot and will not be liable for any loss or damage caused by the aforementioned risks.

Breach of Contract Handling

If Mokebi finds or receives reports or complaints from others that users have violated the provisions of this Agreement, Mokebi has the right to delete or block the relevant content at any time without notice, and impose penalties on the relevant accounts of the violating entities, including but not limited to warnings, restrictions or prohibitions on the use of some or all functions, account bans until cancellation, account recovery, and announce the results of the handling.
You understand and agree that Mokebi has the right to punish any violation of relevant laws and regulations or the provisions of this Agreement based on reasonable judgment, take appropriate legal actions against any user who violates the law and regulations, and save relevant information in accordance with laws and regulations to report to relevant departments and cooperate in investigations, etc. Users shall bear all legal responsibilities arising therefrom.
You understand and agree that you shall be solely responsible for any claims, demands or losses claimed by third parties caused or generated by your violation of the provisions of this Agreement or relevant terms of service; if Mokebi suffers losses as a result, you shall also compensate for them.

Intellectual Property Statement

Tian Zixuan is the intellectual property rights holder of this software. All copyrights, trademark rights,Intellectual property rights such as patents, trade secrets, and all information content related to this software (including but not limited to text, pictures, audio, video, graphics, interface design, layout framework, relevant data or electronic documents, etc.) are protected by the laws and regulations of the People's Republic of China and relevant international treaties. Tian Zixuan enjoys the above intellectual property rights, except for the rights that the relevant rights holders should enjoy in accordance with the law.
Without the written consent of Mo Ke Bi or the relevant rights holders, you may not implement, use, or transfer the above intellectual property rights by yourself or authorize any third party for any commercial or non-commercial purpose.
All content uploaded and published by you during the use of this software and services will not result in the transfer of intellectual property rights, portrait rights, etc. due to uploading and publishing.

Terminal security responsibility

You understand and agree that this software, like most Internet software, may be affected by a variety of factors, including but not limited to user reasons, network service quality, social environment, etc.; it may also be disturbed by various security issues, including but not limited to others illegally using user information to harass in reality; other software downloaded and installed by users or other websites visited may contain viruses, Trojans or other malicious programs, threatening your terminal device information and data security, and then affecting the normal use of this software. Therefore, you should strengthen your awareness of information security and personal information protection, pay attention to password protection, so as not to suffer losses.
You may not create, publish, use, or disseminate malicious programs used to steal InkMark accounts, functional accounts, and other people's personal information and property.
It is the common responsibility of InkMark and you to maintain software security and normal use. InkMark will reasonably and prudently take necessary technical measures in accordance with industry standards to protect your terminal device information and data security, but you acknowledge and agree that InkMark cannot provide complete guarantees in this regard.
In any case, you should not easily trust borrowing, password requests or other network information involving property. If it involves property operations, please verify the identity of the other party first, and please always pay attention to Mokkebi's tips on preventing fraud crimes.

Third-party software or technology

This software may use third-party software or technology (including open source code and public domain code that may be used by this software, etc., the same below), and this use has been legally authorized.
If this software uses third-party software or technology, Mokkebi will, in accordance with relevant laws and regulations or agreements, display the relevant agreements or other documents through the attachments to this agreement, in a specific folder of this software installation package, or through the open source software page, etc. They may be expressed in the form of "Software License Agreement", "Authorization Agreement", "Open Source Code License" or other forms. The aforementioned relevant agreements, other documents and web pages displayed in various forms are an integral part of this agreement and have the same legal effect as this agreement. You should comply with these requirements. If you fail to comply with these requirements, the third party or state agency may sue you, impose fines or other sanctions, and require Mokkebi to assist you. You should bear the legal responsibility yourself.
Any disputes arising from third-party software or technology used in this software shall be resolved by the third party, and Mokbi shall not bear any responsibility. Mokbi does not provide customer service support for third-party software or technology. If you need support, please contact the third party.

Disclaimer

This service is for your personal use only and shall not be provided to any third party. You agree that Mokbi shall not be liable for any losses caused by unauthorized use of this service.

During the use of this service, it may be interrupted, delayed or interfered with during unknown periods due to uncontrollable reasons. You agree that Mokbi shall not be liable for any claims caused by or related to the aforementioned interruptions, delays, interferences or similar failures.

To the maximum extent permitted by applicable law, Mokkebi assumes no liability for any damages caused by your or anyone else's inability to access or use the Service due to the following reasons:

(a) Mokkebi's maintenance or upgrade of systems or software and hardware resulting in suspension or termination of the Service;

(b) delays or failures in system or network communications not owned or controlled by Mokkebi;

(d) other reasons beyond Mokkebi's reasonable control.

The Service is provided on an "as is" and "as available" basis without any warranty or endorsement of any kind. To the maximum extent permitted by applicable law, Mokebi does not acknowledge any express or implied warranties, conditions or other agreements, and makes no guarantees, promises, representations or assurances regarding:

(a) the completeness, accuracy, reliability or timeliness of any content obtained under or through the Service;

(b) whether the Service or the server hosting the Service contains defects, errors, viruses, vulnerabilities or other harmful elements;

(d) warranties related to specific features of the Service, or whether any information obtained by you when using or accessing the Service is reliable, high-quality or accurate;

(e) whether the Service is secure and error-free;

(f) whether the Service is reliable, high-quality, accurate, available or able to meet your needs, produce specific results or achieve specific results or outcomes. Mokebi assumes no responsibility for any loss or damage caused by reliance on, use or interpretation of the Service in whole or in part, or by information obtained by you (or anyone else) when accessing and/or using the Service.

The laws of some countries do not allow the exclusion or limitation of certain warranties, guarantees or liabilities in contracts. If these laws apply to you, all or part of the above exclusions or limitations may not apply. Nothing in this Agreement affects your statutory rights as a consumer.

Termination by You

You may terminate this Agreement by ceasing to use the Service.

Termination or Suspension by Mokkebi

We may suspend, restrict, cancel or terminate your access to all or part of the Service in accordance with applicable law without liability to any person or third party. We will endeavor to notify you before taking such action. However, we may immediately suspend, restrict, cancel or terminate your access to all or part of the Service without prior notice if the following circumstances occur:

(a) You violate or Mokkebi has reason to believe that you are about to violate this Agreement, including any agreements, policies or guidelines contained therein;

(b) You or anyone acting on your behalf engages in fraudulent or illegal activities, or provides Mokkebi with false or misleading information;

(d) To perform urgent system or hardware maintenance or updates;

(e) For unforeseen technical, security or business reasons.

The expiration or termination of this Agreement shall not affect the conditions in this Agreement that are expressly stated to be operational or continue to be effective after its expiration or termination, nor shall it affect any accrued benefits or obligations or any rights or obligations that should continue to be effective after the expiration or termination of this Agreement. Any terms in this Agreement that expressly or by their nature should survive termination shall continue to remain in full force and effect after termination until the conditions in such terms are satisfied or they should expire by their nature.

General Terms

You fully understand that your personal information or any other information collected by Mokkebi may be stored and processed in other countries. You expressly declare and warrant that you will not (and Mokkebi does not accept) upload, synchronize, or transmit any software, technical data, or any other information subject to the export control regulations of the U.S. Bureau of Industry and Security through the services provided by Mokkebi. If you do not comply with the above guarantees, your actions will be deemed as "export" under the U.S. export control regulations, and you may face penalties. Mokkebi does not assume any responsibility to the maximum extent permitted by law.

This service or third parties may provide links to other websites or resources. You understand and agree that we are not responsible for the availability of such external websites or resources, nor do we endorse or assume any responsibility for any content, advertising, products, or other information on or obtained from such websites or resources. We are not responsible for any damage or loss caused or alleged to be caused by or related to your use or reliance on any content, goods, or services obtained through such websites or resources.

Nothing in this Agreement shall be deemed to establish any partnership or agency relationship between you and Mokkebi. Neither party shall have the right to incur any liability, debt or cost, or enter into any contract or other agreement in the name or on behalf of the other party.

Mokkebi shall not be liable for any failure or delay in performing its obligations under this Agreement or these Terms of Service caused by or resulting from events beyond its reasonable control.

Mokkebi Company and its developers are third-party beneficiaries of this Agreement and may enforce this Agreement as parties to this Agreement. Mokkebi has the right to transfer, subcontract or replace Mokkebi's rights and obligations under this Agreement without prejudice to your rights and interests.

If any clause in this Agreement is deemed invalid, ineffective or unenforceable by a court of competent jurisdiction or any other competent authority, the clause shall be deemed to have been deleted from this Agreement, but any other clauses shall remain legally effective.

Others

Your use of this software shall be deemed to have read and agreed to be bound by this Agreement. Mokkebi has the right to modify the terms of this Agreement when necessary. You can review the relevant terms of the agreement in the latest version of this software. After the terms of this Agreement are changed, If you continue to use this software, you will be deemed to have accepted the modified Agreement. If you do not accept the modified Agreement, you should stop using this software.
This Agreement is signed in Xinghualing District, Taiyuan City, Shanxi Province, People's Republic of China.
The establishment, effectiveness, performance, interpretation and dispute resolution of this Agreement shall be subject to the laws of the mainland of the People's Republic of China (excluding conflict of laws).
If any dispute or controversy arises between you and Mo Ke Pen, it should be resolved through friendly negotiation first; if the negotiation fails, you agree to submit the dispute or controversy to the People's Court with jurisdiction over the place where this Agreement is signed.
The titles of all clauses of this Agreement are only for reading convenience and have no actual meaning in themselves, and cannot be used as the basis for the interpretation of the meaning of this Agreement.
This Agreement may be available in multiple languages, including Chinese and English. If there is a conflict between the Chinese version and the version in other languages, the Chinese version shall prevail.
Regardless of the reason why some of the terms of this Agreement are invalid or unenforceable, the remaining terms remain valid and binding on both parties.

Amendments to this Agreement

Moker has been updating, revising and improving this Service. Moker may add or remove features or performance for this Service, set new restrictions or temporarily suspend or permanently stop providing a service; Moker may also revise this Agreement at any time based on the update of this Service.

Once the updated terms of the Agreement are published, they will replace the original terms of the Agreement, and we will promptly publish the changes to this Agreement on the page. If you do not accept the revised agreement, please stop using this Service immediately. Your continued access or use of this Service will be deemed to accept the revised agreement.

If the revision of this Agreement will seriously affect you or severely restrict your access or use of this Service, we will notify you within a reasonable time before the change. For revisions to this Service to meet security, legal or regulatory requirements, we may not be able to meet the aforementioned notice time requirements, but we will notify you as soon as possible.

This policy will be effective from April 1, 2025
